Terms of Use

The short version

  • BinHex is free to use for personal and professional work.
  • We work hard to make the results correct, but check results before relying on them for anything critical.
  • BinHex is provided “as is”.

These terms are an agreement between you and Auvler Systems, based in Ontario, California (“we”, “us”), for the use of the BinHex app and the BinHex pages on auvler.com (the “Service”). By using BinHex, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use BinHex.

1. Using BinHex

We give you a personal, non-exclusive, non-transferable license to use BinHex on devices you own or control, for personal or professional work. You may not sell, rent or redistribute the app, or use it to break the law.

2. Your content

What you type into BinHex is yours. It stays on your device; we don't receive it or claim any rights to it.

3. Accuracy

BinHex is tested to give correct conversions, but software can have errors. Double-check results before using them where a mistake could cause harm or loss, such as production systems, firmware, financial or safety-related work.

4. Our rights

The BinHex app, name, icon and design belong to Auvler Systems. These terms don't give you any rights to them other than the license to use the app.

5. Changes to the Service

We may change, add or remove features, or stop offering BinHex. Because the app works on your device, the version you have will usually keep working.

6. Disclaimers

BinHex is provided “as is” and “as available”, without warranties of any kind, to the extent allowed by law. We don't promise it will be error-free or always available.

7. Limitation of liability

To the extent allowed by law, Auvler Systems won't be liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or opportunities, arising from your use of BinHex. Our total liability for any claim related to BinHex is limited to the greater of the amount you paid us for BinHex in the 12 months before the claim, or $50. Some places don't allow these limits, so they may not apply to you.

8. Disputes and governing law

These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Before filing a claim, please contact us at [email protected] so we can try to resolve it informally. Any dispute that can't be resolved this way will be handled in the state or federal courts located in San Bernardino County, California, unless the law where you live gives you the right to bring it elsewhere.

9. App stores

If you got BinHex from the Apple App Store, Apple's terms also apply to the download. These terms are between you and Auvler Systems, not Apple. Apple is not responsible for BinHex or its support, maintenance, or any claims about it; we are. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

10. Changes to these terms

We may update these terms. We'll change the date at the top. If you keep using BinHex afterward, you accept the new terms.
